Terms of Service

1. Definitions

In these terms and conditions, the following terms are defined:

  • Botdesk: the service provider and owner of the website and services under the name Botdesk (hereinafter: “Botdesk”), located in the Netherlands.
  • Client: any natural person or legal entity that enters into an agreement with Botdesk or negotiates for this purpose.
  • Services: all (AI) services provided by Botdesk, including AI customer bots, automations, integrations, (custom) GPT solutions, consultancy, implementation, maintenance, support, training and related work.
  • Agreement: the arrangement between Botdesk and Client regarding the delivery of Services.
  • Website: the Botdesk website, including subdomains and landing pages.
  • Content: all texts, prompts, datasets, documents, images, code and other materials provided by Client or generated within the Services.
  • Working days: Monday to Friday, excluding Dutch public holidays.

3. Applicability

  1. These general terms and conditions apply to all quotations, offers, (pre)contractual actions and Agreements of Botdesk.
  2. Deviations only apply if Botdesk confirms them in writing.
  3. Any purchasing or other terms and conditions of Client are expressly rejected, unless Botdesk confirms otherwise in writing.
  4. If a provision is void or voidable, the remaining provisions remain in force. The parties replace the invalid provision with a valid provision with as much as possible the same intent.
